The deregulation and privatisation of the railway sector has changed the responsibilities between the railway companies and the rolling stock manufacturers significantly. Furthermore German legislation on regional and commuter rail services has led to new legal relationships between the public authorities that are responsible for the allocation of contracts for these services on one side and the railway companies on the other side.

Many legal problems raised by these changes are still remaining unsolved. In addition to that the legislation on the railway sector will undergo further changes due to corresponding endeavours of the European Union.
